The Legal Issues Facing the Proposed Private Marina

Saugatuck Dunes Coastal Alliance ran a series of ads in our local newspapers detailing the various legal issues with the proposed private marina. The laws are clear – the proposed marina is illegal. Let’s enforce our laws and stop this proposed private marina.

THE LAST UNDEVELOPED RIVER MOUTH

The Essential Character of this area is Designated Natural Area.
The proposed marina violates Zoning Ordinance Sec. 40-779 and Sec. 40-693 and The Tri-Community Master Plan

SAND DUNE MINING IS ILLEGAL

“Sand dune mining” means the removal of sand from sand dune areas for commercial or industrial purposes, or both.

The proposed Padnos marina violates the intent of Part 637 ofMichigan’s Natural Resources and Environmental Protec on Act 451.

OUR RIVER DRIVES OUR TOURIST-BASED ECONOMY

“The department shall not grant a permit if the proposed project or structure will unlawfully impair or destroy any of the waters or other natural resources of the state.”

Michigan’s NREPA 451, Part 301, Sec. 30106.

OUR RIVER & BEACHES ARE AT RISK

The Army Corps has detailed concerns about theproposed Padnos marina by writing:

“Construction of a long, narrow basin with a single opening to the Kalamazoo River may create stagnant water conditions… accumulation of nutrients, and excess hearing.”

NO DIGGING ALLOWED

NorthShore of Saugatuck does not have all the necessary permits to dig the proposed marina.

  1. The Army Corps of Engineers has NOT issued a final decision.

OUR PUBLIC INTEREST IS VIOLATED!

The Army Corps of Engineers (ACE) cannot issue a permit ‘if the proposed project is found to be contrary to the public interest.’

Criteria include Navigation, Historic Properties, Threatened & Endangered Species, Water Quality, and Wetlands.
