Judge Quashes Subpoenas Associated with North Shores’s SLAPP-style Lawsuit

Allegan County Circuit Court Matthew Antkoviak today stayed discovery and quashed all of the 56 subpoenas issued by North Shores of Saugatuck, LLC in July and August to Coastal Alliance board members and supporters, as well as to government officials, scientists, and others. The subpoenas were associated with North Shores's baseless lawsuit against the Coastal Alliance and board president David Swan that claimed the organization engaged in conspiracy and tortious interference in its efforts to stop North Shores’ failed marina project.

As a result of the Judge’s ruling, all of the people and entities subpoenaed are no longer required to respond to the subpoenas. The Coastal Alliance’s attorney will provide a written notice of the ruling to all those subpoenaed once the written order has been issued. Depending on how the lawsuit moves forward, North Shores may issue new subpoenas.

Judge Antkoviak has set a hearing for 10 a.m. on October 10 for arguments on North Shores’ motion to amend its original lawsuit.
